VIRGINIA BEACH - Two men charged in the murder of a police officer last year were in court Thursday afternoon.

Ted Carter and Marshall Moyd are suspects in the August 2008 killing of Det. Michael Phillips.
The 37-year-old officer was working an undercover drug operation in the parking lot of Green Run Square Shopping Center. Police say he was shot three times while sitting in a pick-up truck with one of two men charged in his death.
In court, it was revealed the Det. Phillips was wearing a wire.
He wasn't wearing a bullet-proof vest when he went to buy half a pound of marijuana in a sting involving two suspects, according to police.
After the shooting, one suspect drove off in an SUV while the second was arrested as he searched the officer's body for money, authorities stated.
Phillips had been with the Va. Beach Police Department for six years. He served three years with the Hampton Police Department before that.
Carter and Moyd were charged with first degree murder, use of a firearm in the commission of a felony and conspiracy to violate the drug conspiracy act.
After hearing evidence Thursday, the judge certified the murder and robbery charges but not the drug charges.
