VIRGINIA BEACH, Va. (WVEC) -- Jonnathan Miller, charged with murder, would not say if he was guilty or innocent of the crime during a jailhouse interview Tuesday.
Miller, 20, was arrested by police Monday in connection to the shooting death of Devin Lowery last week.
A neighbor living along Shallowford Circle found the 23-year-old's body lying lifeless on the ground May 2.
Miller, who lives in Chesapeake, said he did not know Lowery before his arrest.
He said police detectives told him two people accused him of the killing, and cell phone records placed him at the crime.
Police did not confirm the evidence against him.
In an interview with 13News Now, Miller refused to say if he was at the crime scene, or knew what happened.
When asked if he killed Lowery, Miller replied, "I really can't say yea, or nay."
He suggested it was possible the shooting was an act of self-defense, or an accident.
While he would not go into specifics, Miller did apologize to the family and asked that leniency be shown to the person responsible for the killing.
"My heart goes out to that person, I'm sorry that he passed away in these circumstances," Miller said. "I just pray that they have some type of leniency for the person that did it."
When asked if the suspect may or may not be him, Miller replied laughing. "May or may not be, that's correct...I'm not going to say yes or no."
Miller said he had been advised by an attorney not to go into details.
He said he would wait to see the prosecution's case against him before deciding whether to plead guilty or not guilty.
