New charges for man accused of shooting at Va. Beach police

Christopher Cody Smith, 23, is charged with Strangulation, Aggravated Assault and Use of a Firearm in commission of a Felony.

VIRGINIA BEACH, Va. (WVEC) -- A man accused of firing at Virginia Beach police officers last May now faces two charges of attempted capital murder of a police officer.

Christopher Cody Smith, 23, was indicted on six felony charges Monday. 

Smith was arrested following the shooting at Emerald Point Apartments in the 1900 block of King Henry Court in Hilltop.

Police say Smith's wife, Brittany, and a man had been hurt by Smith around 11:40 p.m. on May 1. Officers say Mrs. Smith had a fight with her husband; the circumstances that led to the man being shot weren't known, but he was in ICU late Tuesday.

Authorities said Smith started shooting at officers who were trying to help the man who'd been shot. They said Smith ran into a building and officers fired at him.

Smith allegedly climbed out of a window and tried to run off. Officers told him to drop his gun and they said he did. They took him into custody.

Smith was treated for a gunshot wound on his leg and then taken to jail, authorities said. Prosecutors said Smith was intoxicated when he was taken into custody.
