NEWPORT NEWS, Va. — The Newport News School Board wants the Virginia Supreme Court to overturn the ruling that allows the former teacher who was shot by her 6-year-old student to sue.
Abby Zwerner filed a $40 million lawsuit against the school board after the boy shot her during class on January 6, 2023, at Richneck Elementary School. Back in November, a judge ruled her lawsuit could move forward, denying claims from the school board that Zwerner's injuries are covered under worker's compensation.
Last month, the Virginia Court of Appeals declined to hear the school board's appeal which could have stopped the lawsuit from going to trial. It's not yet known if the Supreme Court will take up the school board's appeal.
That jury trial had been slated to begin on Jan. 21, 2025, just over two years since the shooting.
