HAMPTON, Va. — The father accused of killing his then 4-year-old son and concealing his body appeared in a Hampton courtroom on Tuesday morning to determine if two specific witnesses would be allowed to testify in his upcoming trial.
Cory Bigsby’s legal team wanted to have two doctors who had determined if he was fit to stand trial be added to the witness list. They claim they wanted the jury to hear about Bigsby’s mental health while he was in jail.
Prosecutors argued the doctors were only hired to determine if Bigsby was competent to stand trial, and nothing more.
The judge ultimately sided with the Commonwealth and took the two doctors off the witness list during Tuesday's hearing.
The Hampton father reported his son Codi Bigsby missing in January of 2022. This past June, prosecutors filed charges against Bigsby for Codi's murder.
Bigsby is charged with murder and the concealment of a body, along with dozens of counts of child neglect and abuse for allegedly leaving his other children home alone, charges unrelated to Codi's disappearance. His trial is set to begin on March 4 in Hampton.
Codi Bigsby's body has never been found.
