A man has been arrested on a rape charge in Williamsburg, police announced Wednesday.
Williamsburg Police were dispatched to the 700 block of Scotland Street for an assault on Sunday around 1:50 a.m. The area sits across from the campus of William & Mary.
Orlando R. Rodriguez Rivera, 41, faces a charge of rape through the use of the victim’s mental incapacity or physical helplessness.
A Williamsburg police spokesperson told 13News Now alcohol played a factor in filing that specific criminal charge.
The victim, described by police as a 36-year-old woman, gave her account to investigators.
When officers arrived on Scotland Street, court documents said they found a woman covered in blood and blood on the ground in a back alley.
The criminal complaint detailed the woman tearfully recalling a man she was with named Orlando asking her for oral sex. She said she tried to do it but then fell over and couldn’t, according to the court documents.
The victim then told investigators Rodriguez Rivera had intercourse with her she didn’t consent to and didn’t want.
Area surveillance video allegedly shows Rodriguez Rivera walking to an alley where the victim said the assault happened.
The two were inside Brickhouse Tavern, which is around the corner from the alley, before the incident, police investigators said.
A restaurant employee told 13News Now the pair shared a meal inside. Staff members didn’t know them.
The employee also said they didn’t know about the incident until after the fact.
Brickhouse Tavern is letting detectives look at their security camera footage.
Some students and people who live nearby said they didn't know about what happened over the weekend and that they were shocked.
Medics took the woman to the hospital, where a Sexual Assault Nurse Examiner or SANE medical professional saw her, court documents stated.
Police added Rodriguez Rivera wasn’t there by the time officers arrived on scene. Records said the victim gave officers the suspect’s contact information.
They later identified Rodriguez Rivera as the suspect. Law enforcement arrested him at his home in York County at around 8 a.m. on the same day of the incident, Sunday.
Rodriguez Rivera is at Virginia Peninsula Regional Jail without bail. He has a court hearing scheduled for March.
