VIRGINIA BEACH, Va. — A man convicted of killing a 65-year-old woman at a Virginia Beach gas station in 2021 was sentenced to three life terms in prison Tuesday.
The sentencing for Darrius White, 25, comes after he was found guilty of aggravated murder, two counts of robbery causing death and three counts of using a firearm in the commission of a felony. His sentence includes three life terms, one without the possibility of parole, plus 13 years.
According to the Virginia Beach Commonwealth's Attorney, Circuit Court Judge James C. Lewis told White during sentencing, “Your DNA has an evil streak that can’t be rehabilitated, changed, or eliminated.”
The shooting happened on Dec. 13, 2021, at the Harris Teeter in Haygood Shopping Center, leaving Annie Smith dead.
Prosecutors said Darrius White committed the robbery with his brother, on Dec. 13, 2021. Smith and her husband visited family, ran some errands and stopped for gas. While Smith's husband pumped gas, brothers Michael and Darrius White pulled in.
The encounter led to the brothers demanding property from the couple, and then Darrius White shot Smith three times in the chest. The Whites fled the scene.
The Whites were driving a vehicle they had stolen earlier that day in Chesapeake. Police had a description of the suspects and the car used in the murder. Shortly after, the vehicle's owner spotted them driving his stolen car. They fled and police found Michael White's fingerprints all over the car.
Darrius White's trial had previously been declared a mistrial in May 2023.
Michael White pled guilty to charges of first-degree murder, robbery causing death, use of a firearm and possession of a firearm by a convicted felon. He was sentenced to 50 years in prison.
